El artículo 93.1.b) de la Ley del IRPF permite aplicar el régimen especial de trabajadores desplazados (Ley Beckham) a quien se traslada a España para adquirir la condición de administrador de una entidad. Es la vía que usan muchos fundadores de startups, socios de sociedades familiares que se trasladan a España, o directivos que asumen la administración de una filial española.
Article 93.1.b) of the Personal Income Tax Law allows the special regime for relocated workers (Beckham Law) to apply to someone who moves to Spain to become the director of an entity. It is the route used by many startup founders, partners in family companies relocating to Spain, or executives taking over the management of a Spanish subsidiary.
El problema aparece cuando la sociedad ya existía, o cuando el nombramiento se produce de forma poco clara respecto a la fecha del traslado. Ahí es donde entra el criterio de la DGT.
The problem arises when the company already existed, or when the appointment happens in a way that is unclear relative to the date of the move. That is where the DGT’s criterion comes in.

Una consulta vinculante reciente de la Dirección General de Tributos (DGT) recuerda algo que muchos pasan por alto: no basta con ser administrador de una sociedad española en el momento del traslado. Debe existir una relación de causalidad entre el desplazamiento a España y la adquisición de la condición de administrador. Dicho de otra forma: el nombramiento tiene que ser la causa de que vengas a España, no una consecuencia de que ya estás aquí.
A recent binding ruling from the Directorate-General for Taxes (DGT) reminds us of something many overlook: it is not enough to be the director of a Spanish company at the time of the move. There must be a causal link between relocating to Spain and becoming a director. In other words, the appointment has to be the cause of coming to Spain, not a consequence of already being here.
La propia DGT reconoce que esta causalidad es una cuestión de hecho, y que la carga de probarla recae íntegramente sobre el contribuyente. Si Hacienda entiende que primero te mudaste (por ejemplo, por motivos personales) y después, ya instalado en España, te nombraron o constituiste la sociedad, puede rechazar la aplicación del régimen aunque formalmente cumplas el resto de requisitos.
The DGT itself acknowledges that this causal link is a question of fact, and that the burden of proving it falls entirely on the taxpayer. If the Tax Agency concludes that you moved first (for personal reasons, say) and only afterwards, once settled in Spain, were appointed director or incorporated the company, it can reject the regime even if you formally meet every other requirement.

Aquí está la parte que genera más confusión: la norma no dice literalmente «debes constituir la sociedad antes de pisar España». Lo que exige es que puedas demostrar que tu nombramiento como administrador fue el motivo del traslado. En la práctica, eso hace que constituir la sociedad —o al menos formalizar tu nombramiento— antes o en el mismo momento del traslado sea, con diferencia, la opción más segura.
Here is the part that causes most confusion: the rule does not literally say “you must incorporate the company before setting foot in Spain”. What it requires is that you be able to prove that your appointment as director was the reason for the move. In practice, that makes incorporating the company —or at least formalising your appointment— before or at the same time as the move by far the safest option.

- If you move first “to explore” and incorporate afterwards, you will need solid documentary evidence (contracts, emails, minutes) that the business project was already decided before the trip.

Decide primero la fecha de constitución y nombramiento, y ajusta tu traslado físico a España después de esa fecha, o como muy tarde de forma simultánea.
Decide the incorporation and appointment date first, and schedule your physical move to Spain after that date, or at the very latest simultaneously with it.

Guarda correos, contratos preliminares, actas y cualquier evidencia de que la decisión de crear o dirigir la sociedad española existía antes del traslado.
Keep emails, preliminary contracts, minutes and any evidence that the decision to create or run the Spanish company existed before the move.

Tienes seis meses desde el alta en la Seguridad Social o el inicio de la actividad para comunicar la opción. Presentarlo con la documentación de causalidad ya lista reduce el riesgo de requerimientos posteriores.
You have six months from your Social Security registration or the start of the activity to notify the option. Filing it with the causality documentation already in place reduces the risk of later information requests.
Muchos extranjeros constituyen su sociedad española con una gestoría genérica sin coordinar las fechas con su planificación fiscal de la Ley Beckham. El resultado, meses después, es una solicitud débil o una comprobación de Hacienda que se podría haber evitado con una secuencia bien planificada desde el principio.
Many foreign nationals incorporate their Spanish company through a generic formation service without coordinating the dates with their Beckham Law tax planning. The result, months later, is a weak application or a tax audit that could have been avoided with a well-planned sequence from the outset.
