Desde la reforma del Estatuto del Contribuyente de 1998 (antes el plazo era de cinco años), la Administración tributaria dispone de 4 años para determinar la deuda mediante liquidación, para exigir el pago de las deudas liquidadas y autoliquidadas, y para imponer sanciones tributarias. Transcurrido ese plazo sin que se produzca una actuación válida que lo interrumpa, la deuda prescribe y Hacienda pierde el derecho a reclamarla.
Since the 1998 reform of the Taxpayer’s Charter (the period used to be five years), the Tax Administration has 4 years to determine a debt through an assessment, to demand payment of assessed and self-assessed debts, and to impose tax penalties. Once that period elapses without a valid interrupting action, the debt prescribes and the Tax Agency loses the right to claim it.
El derecho de Hacienda a comprobar e investigar ejercicios anteriores, aunque estén prescritos a efectos de liquidación, no prescribe desde la reforma de 2015. Esto significa que Hacienda puede revisar hechos de años prescritos si afectan a la tributación de ejercicios posteriores no prescritos (por ejemplo, bases imponibles negativas, que tienen un plazo específico de 10 años).
The Tax Agency’s right to review and investigate prior tax years, even if they are prescribed for assessment purposes, has not itself prescribed since the 2015 reform. This means the Tax Agency can review facts from prescribed years if they affect the taxation of later, non-prescribed years (for example, negative tax bases, which have their own 10-year period).

El artículo 66 de la Ley General Tributaria enumera las actuaciones que interrumpen la prescripción y reinician el plazo de cuatro años desde cero. En resumen, pueden venir de dos lados:
Article 66 of the General Tax Law lists the actions that interrupt prescription and restart the four-year period from scratch. In short, they can come from two directions:
- Por parte de Hacienda: cualquier actuación formal dirigida a reconocer, regularizar, comprobar, inspeccionar, asegurar o liquidar el tributo, siempre que se notifique correctamente al contribuyente.
- From the Tax Agency: any formal action aimed at recognising, regularising, checking, inspecting, securing or assessing the tax, provided it is correctly notified to the taxpayer.
- Por parte del contribuyente: interponer un recurso o reclamación, o realizar cualquier actuación fehaciente que conduzca a la liquidación o autoliquidación de la deuda —por ejemplo, presentar una autoliquidación complementaria.
- From the taxpayer: filing an appeal or claim, or carrying out any documented action leading to the assessment or self-assessment of the debt — for example, filing a supplementary self-assessment.
El límite: no todo «requerimiento» vale para reiniciar el plazoThe limit: not every “request” resets the period
Aquí está la parte más importante para cualquier contribuyente con una deuda antigua. El Tribunal Supremo ha dejado claro que, para interrumpir la prescripción, un requerimiento de Hacienda debe ser real, tener contenido sustantivo y perseguir efectivamente la liquidación del tributo, no ser un mero trámite de relleno.
This is the most important part for any taxpayer with an old debt. The Supreme Court has made clear that, to interrupt prescription, a request from the Tax Agency must be genuine, have substantive content and actually pursue the assessment of the tax, rather than being a mere box-ticking formality.
Los tribunales han anulado en numerosas ocasiones las llamadas diligencias argucia: actuaciones aparentemente formales cuyo único propósito real es reiniciar artificialmente el plazo de prescripción, sin que exista detrás una comprobación efectiva. Si Hacienda te notifica un requerimiento vacío de contenido justo antes de que tu deuda prescriba, puede que ese requerimiento no sea válido para interrumpir el plazo.
The courts have repeatedly struck down so-called sham formalities: seemingly formal actions whose only real purpose is to artificially reset the prescription period, with no genuine review behind them. If the Tax Agency notifies you of a content-empty request just before your debt would prescribe, that request may not be valid to interrupt the period.

Check whether any request is genuinely valid to interrupt the period
Si detectamos una diligencia sin sustancia real, puede ser la base para alegar la prescripción de toda la deuda.
If we detect a request with no real substance, it can be the basis for arguing that the whole debt has prescribed.
Recurre en plazo si la deuda ya debería estar prescrita
Appeal in time if the debt should already be prescribed
La prescripción no se aplica de oficio siempre: conviene alegarla expresamente en el procedimiento correspondiente.
Prescription is not always applied automatically: it is worth expressly invoking it in the relevant procedure.
