Una trabajadora contratada por 20 horas semanales reclamaba que en realidad trabajaba en dos tramos diarios que sumaban ocho horas, muy por encima de su jornada pactada. La empresa no aportó ningún registro de jornada. El tribunal confirma la condena a abonar las horas extra, entendiendo suficiente que la trabajadora identificara los periodos reclamados, la habitualidad del exceso y su cuantificación, sin necesidad de detallar día por día cada jornada.
An employee contracted for 20 hours per week claimed she actually worked two daily shifts totalling eight hours, well above her agreed working time. The company provided no time record whatsoever. The court confirms the order to pay the overtime, finding it sufficient that the employee identified the periods claimed, the regularity of the excess and its quantification, without needing to detail each individual day.

La simple ausencia de registro horario no equivale automáticamente a dar por probadas todas las horas extra reclamadas por un trabajador. Pero en cuanto este acredita, aunque sea con prueba testifical, una base mínima de exceso de jornada respecto a lo pactado, el incumplimiento del deber empresarial de registrar la jornada (artículo 34.9 del Estatuto de los Trabajadores) traslada la carga de la prueba a la empresa. Si esta no puede demostrar cuál fue realmente la jornada cumplida, el exceso reclamado se da por acreditado.
The mere absence of time records does not automatically mean all the overtime claimed by an employee is taken as proven. But as soon as the employee proves, even through witness testimony, a minimum basis for exceeding the agreed working time, the company’s failure to comply with its duty to record working hours (Article 34.9 of the Workers’ Statute) shifts the burden of proof onto the company. If the company cannot show what the actual working hours were, the claimed excess is taken as proven.

El riesgo es especialmente alto en contratos a tiempo parcial, donde cualquier prolongación habitual de la jornada puede convertirse fácilmente en una reclamación de horas extra —o incluso derivar en la conversión del contrato a tiempo completo. Llevar un registro horario diario, firmado o validado por el propio trabajador, sigue siendo desde 2019 una obligación legal para todas las empresas, independientemente de su tamaño, y es la mejor defensa frente a reclamaciones de este tipo.
The risk is especially high in part-time contracts, where any habitual extension of the working day can easily turn into an overtime claim —or even lead to the contract being converted to full-time. Keeping a daily time record, signed or validated by the employee themselves, has been a legal obligation for all companies since 2019, regardless of size, and remains the best defence against claims of this kind.
